TERMS OF USE AND DATA PROTECTION FOR COMPANIES

PRIVACY AND LIMITED USE OF DATA
We never sell or disclose personal registration data to third parties for advertising or purposes unrelated to the job board. Registration does not authorise advertisers to use contact persons' data and does not mean that you agree to receive advertising.
This commitment does not exclude necessary access by technical service providers, disclosures required by law or the publication of company information and vacancies intended for candidates. Candidate data accessed by a company may only be used for the stated recruitment purpose and with a valid legal basis.

1. SERVICE OWNER AND CONTACT
The owner of Ingenieros.es and data controller is PLATAFORMA DE INGENIERIA Y DESARROLLOS TECNOLÓGICOS SL, tax identification number B-71011826, with its registered office at c/Manuel Martinez de Ubago, 28, 31012 Pamplona (Spain). Registered in the Commercial Register of Navarra on 22 March 2010, volume 1506, page 22, registry sheet NA-29922, first entry.

These terms are interpreted in accordance with Spanish and European Union law, including Regulation (EU) 2016/679 (GDPR), Spanish Organic Law 3/2018 (LOPDGDD) and Spanish Law 34/2002 (LSSI-CE), as applicable.

2. REGISTRATION, REPRESENTATION AND CONTRACTING
The person registering a company must be authorised to act on its behalf and provide truthful, up-to-date information. The email address must be verified through the activation link. Fields marked with an asterisk are required to process registration; without them it cannot be completed. Other fields are optional.
The account allows use of the available features to publish vacancies and manage applications. Ingenieros.es is not the employer and does not guarantee that vacancies will be filled, candidates will be suitable or a particular recruitment outcome will be achieved.
Recruitment and human resources companies may use the service where they are entitled to carry out their activities, correctly identify their role and comply with applicable law. They may not impersonate the employer or conceal information that must be provided to candidates.
Registration alone does not mean purchasing paid services. Before any contract is concluded, the applicable scope, price, taxes, duration, renewal and cancellation terms must be provided, and acceptance of the specific terms must be obtained. Information can be requested at info@ingenieros.es.

3. RULES FOR PUBLISHING VACANCIES
Vacancies must be genuine, clearly describe the role and its relevant conditions and offer a legally valid employment or professional relationship. The company must be authorised to publish and comply with labour, equality and non-discrimination rules applicable to the role.
Vacancies involving unlawful discrimination on grounds of sex, origin, age, disability, religion, sexual orientation or other protected circumstances; fraudulent or misleading vacancies; vacancies requiring candidates to pay or invest money; and pyramid or multilevel schemes or business opportunities presented as employment will not be accepted.
As part of the portal's editorial policy, vacancies related to adult entertainment or nightlife will not be accepted either. The candidate job board is intended for people over 18.
Each vacancy must correspond to an identifiable role. Duplicates of the same role and location and publications intended solely to redirect users to another employment website will not be accepted. Different roles must be published separately.
Company contact details are not allowed in descriptions or reply messages where those fields are intended to manage applications through the portal. The fields and channels provided for that purpose must be used.
Premium-rate numbers or other mechanisms imposing a cost on candidates to obtain information or take part in recruitment are not allowed. Information must be sufficient and must not be misleading.
The company is responsible for the truthfulness and lawfulness of its publications and must update or remove vacancies that are no longer available. It may not sell, resell or extract vacancies, profiles or CVs from the portal in bulk without the required authorisation.

4. OBLIGATIONS REGARDING CANDIDATE DATA
The company may only access data legitimately made available by the service features and applicable permissions. Accepting these terms neither extends permissions nor authorises access to any CV.
Access must be limited to managing the application or stated recruitment purpose. Bulk extraction, creation of commercial databases, sale or disclosure for advertising, sending promotional communications and any incompatible reuse without an independent, valid legal basis are prohibited.
Where the company determines the purposes and means of its recruitment process, it is the controller of its own processing. It must inform candidates under Articles 13 or 14 GDPR, as applicable, specifying its identity, contact details, purpose, legal basis, recipients, retention and rights. Merely accessing a CV does not amount to consent for any use.
The company must limit data to what is necessary, restrict access to authorised personnel, adopt security measures appropriate to the risk and respond to the exercise of rights. It must not retain data indefinitely or use withdrawal of profile visibility on the portal as a reason to ignore erasure requests or objections.
It must not retain CVs for future processes or disclose them to other companies without a valid legal basis and the appropriate information; where consent is necessary, it must be obtained specifically. Recruitment companies must explain their role and planned disclosures to their clients.
Providers processing data on behalf of the company must be subject to a data processing agreement where applicable. International transfers, if any, must comply with Chapter V GDPR.
The company must notify Ingenieros.es without delay, at info@ingenieros.es, of any improper access or incident involving data obtained from the portal and comply with its own obligations to notify the authority and affected individuals where required.

5. DATA PROTECTION FOR REPRESENTATIVES AND CONTACT PERSONS
Personal data protection applies to individuals acting as company representatives, users or contact persons. Data about a legal entity are not in themselves personal data; data about self-employed people and identified or identifiable individuals are personal data.
Ingenieros.es processes the identification, contact and login details provided to manage registration, verify email addresses, administer accounts, handle requests and provide the service. IP addresses and technical logs may also be processed for security.
Where the user contracts the service in their own name, management of the relationship is based on Article 6(1)(b) GDPR. For contacts and representatives of legal entities, necessary professional data will be processed on the basis of the legitimate interest in maintaining relations with the represented entity, within the limits of Article 19 LOPDGDD and Article 6(1)(f) GDPR.
Fraud prevention and security are based on the legitimate interest in maintaining a secure service, subject to balancing rights. Regulatory and invoicing obligations, where applicable, are based on Article 6(1)(c). Optional processing requiring consent will be based on specific and revocable authorisation under Article 6(1)(a).
Personal registration data are not sold or provided to advertisers. Hosting, email, maintenance and security providers may access necessary data. When acting on behalf of Ingenieros.es, they must do so under a data processing agreement, confidentially and following instructions, without using the data for their own purposes. Strictly necessary data may also be disclosed where required by a legal obligation.
Company and vacancy information published for candidates will be visible in accordance with the portal's features. Unnecessary personal data must not be included in public fields.
The form incorporates Google reCAPTCHA to prevent abuse, which involves Google processing technical data according to the applicable configuration and terms. Its privacy policy is available at https://policies.google.com/privacy and its terms at https://policies.google.com/terms.
If a provider involves transfers outside the European Economic Area, the destinations and safeguards actually applicable must be provided in accordance with Chapter V GDPR. Information about recipients and safeguards can be requested at info@ingenieros.es.

6. RETENTION, RIGHTS AND ACCOUNT CLOSURE
Data will be retained while the account is active and they are necessary to provide the service. Account closure and erasure can be requested at info@ingenieros.es. After closure, data that must be retained for legal obligations or potential liabilities will be blocked where applicable for the relevant periods; they will then be erased. Backups will be subject to deletion cycles and restricted access. Technical logs will be retained only for the time necessary for security and investigating incidents.
Data subjects can exercise access, rectification, erasure, objection, restriction of processing and portability where applicable, by writing to info@ingenieros.es and specifying the requested right. Additional identification information will only be requested where necessary to reasonably verify identity.
Consent can be withdrawn at any time without affecting the lawfulness of previous processing. As a general rule, requests will be answered within one month; any extensions will be communicated in accordance with the GDPR. Complaints can be lodged with the Spanish Data Protection Agency (www.aepd.es).
Registration does not constitute authorisation for solely automated decisions producing legal or similar effects. If features of that nature are implemented, the required information and safeguards will be provided beforehand.

7. COMMUNICATIONS AND COOKIES
Messages necessary to activate and protect the account, recover access and manage the requested service may be sent. Registration does not mean agreeing to advertising or subscribing to newsletters.
Commercial communications must have a legal basis permitted by the LSSI-CE and provide a simple, free way to object or unsubscribe. User companies may not use the portal to send unauthorised commercial emails.
Accepting these terms does not mean accepting non-essential cookies. These require the appropriate information and consent through their specific mechanism.

8. SECURITY, MODERATION AND LIABILITY
The company must safeguard credentials and control access by authorised personnel. It must report any suspected misuse. It may not impersonate anyone, bypass access controls, perform unauthorised automated extraction or overload the service.
Ingenieros.es may examine reports of irregularities and proportionately remove content or restrict accounts in response to breaches or risks, with the information and review procedures required by law. To report an inappropriate vacancy or use, write to info@ingenieros.es and identify the content and reason.
Ingenieros.es will adopt technical and organisational measures appropriate to the risk. It does not guarantee absolute security or uninterrupted availability, but retains the responsibilities imposed by law.
The company's liability for its publications and processing does not exclude any liability legally attributable to Ingenieros.es. These terms do not establish a general exemption or a waiver of non-waivable rights.
The company retains its rights to the content it provides and authorises its use only to the extent necessary to publish it and provide the requested features.

9. CHANGES AND DISPUTE RESOLUTION
Substantial changes affecting the service relationship will be communicated with reasonable advance notice. Continued use of the portal will not be interpreted as acceptance of a new processing purpose requiring consent.
Spanish and European Union law apply. Disputes will be submitted to the competent courts under the applicable legal rules, without imposing waivers of mandatory rights or jurisdiction rules.
